1. Acceptance of Terms

By downloading, installing, or using The Daily Fold ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

The Daily Fold is a personalized news reader application that aggregates publicly available RSS and Atom feeds from third-party news publishers into a curated daily edition. The App also includes a daily word puzzle, weather information, and optional premium features.

3. Content Disclaimer

Third-Party Content

The news articles, headlines, images, and other content displayed in the App are sourced from third-party RSS feeds published by independent news organizations. We do not create, edit, endorse, or verify this content. The views and opinions expressed in articles are those of the original publishers and do not reflect the views of F5 Games or The Daily Fold.

We are not responsible for:

• The accuracy, completeness, or reliability of third-party content.
• Content that may be offensive, inappropriate, or objectionable.
• Changes to or removal of content by third-party publishers.
• The availability of any particular news source or feed.

Content Availability

News feeds are provided by third-party publishers who may change, restrict, or discontinue their RSS feeds at any time without notice. We do not guarantee the availability of any specific news source, section, or article.

4. Weather Information

Weather data is provided by Open-Meteo (open-meteo.com), a third-party weather service. Weather information is provided for general informational purposes only. We do not guarantee the accuracy of weather data and it should not be relied upon for critical decisions.

5. User Conduct

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Attempt to reverse-engineer, decompile, or disassemble the App.
• Use the App to distribute malware or engage in malicious activity.
• Circumvent or attempt to circumvent any access restrictions or subscription requirements.
• Use automated systems to excessively access RSS feeds through the App in a manner that could harm feed providers.

6. Premium Subscription

Subscription Plans

The App offers optional premium features available through a paid subscription. Subscription plans and pricing are displayed within the App and the applicable app store.

Billing

All subscription purchases are processed through Apple's App Store or Google Play Store. By subscribing, you agree to the respective app store's terms of payment. F5 Games does not directly process payments or have access to your payment information.

Auto-Renewal

Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription at any time through your device's app store settings.

Free Trial

If a free trial is offered, it will be clearly stated at the time of subscription. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription.

Refunds

Refund requests are handled by Apple or Google in accordance with their respective refund policies. Please contact the applicable app store for refund inquiries.

7. Intellectual Property

Our Property

The Daily Fold app, including its design, layout, user interface, code, and original content (such as the daily puzzle), is the intellectual property of F5 Games. You may not copy, modify, distribute, or create derivative works based on the App without our prior written consent.

Third-Party Property

All news content, images, and trademarks displayed within the App belong to their respective owners. The display of third-party content through RSS feeds does not imply any affiliation with or endorsement by the content owners.

8. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, error-free, or secure.
• Any content will be accurate, reliable, or complete.
• The App will meet your specific requirements.
• Defects will be corrected in a timely manner.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, F5 GAMES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

Our total liability for any claim arising from your use of the App shall not exceed the amount you paid for the App or its subscription in the twelve (12) months preceding the claim.

10. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

11. Changes to These Terms

We may update these Terms from time to time. Any changes will be reflected by updating the "Effective Date" at the top of this document. Your continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.

13. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
